Welcome to Alpha Tech Pet. These Terms of Service (“Terms”) govern your access to and use of alphatechpet.com (the “Site”), including any content, information, products, and services made available through the Site.

By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. About Alpha Tech Pet

The Site is operated by Alpha Tech Pet, Inc., a Massachusetts corporation (“Alpha Tech Pet,” “ATP,” “we,” “us,” or “our”), with its principal place of business at 25 Porter Road, Suite 210, Littleton, Massachusetts 01460. Founded in 1989 and veterinarian-owned, we provide cleaning, sanitation, animal-care, and indoor-air-quality products and information for veterinary practices, pet resorts, kennels, groomers, other animal-care professionals, and pet owners.

2. Eligibility

The Site is intended for users who are at least 18 years of age. By using the Site, you represent that you are at least 18 years old or are using the Site under the supervision of a parent or legal guardian. The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

3. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site in any manner that could damage, disable, interfere with, or impair the Site or its operation, or interfere with another person’s use of the Site.

You may not attempt to gain unauthorized access to the Site, its systems, accounts, networks, or data, and you may not use automated means (such as bots, scrapers, or crawlers) to access the Site without our prior written permission.

4. Accounts

If the Site allows you to create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and current information and to notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

5. Product Information

We make reasonable efforts to provide accurate and current product descriptions, instructions, specifications, images, and other information. However, information on the Site may occasionally contain errors, omissions, or outdated information.

Product packaging, labels, directions, warnings, and other materials supplied with a product may contain information that differs from information displayed on the Site. You should always read and follow the product label, directions for use, warnings, and other accompanying materials before using a product.

For products regulated by governmental agencies, including the U.S. Environmental Protection Agency (EPA), the applicable registered product label governs the lawful use of the product. Products must be used only as directed on the applicable label. It is a violation of federal law to use an EPA-registered product in a manner inconsistent with its labeling.

Nothing on the Site should be interpreted as authorizing a use, application, claim, or representation that is inconsistent with an applicable product label or regulatory requirement.

6. Professional and Educational Information

Information provided on the Site is intended for general informational and educational purposes. It is not intended to replace professional veterinary, medical, regulatory, legal, or other professional advice.

You are responsible for determining whether a product is appropriate for your particular application and for using all products in accordance with applicable instructions, labels, laws, and regulations.

7. Orders and Purchases

If products are available for purchase through the Site, we reserve the right to accept, reject, limit, or cancel an order where permitted by law, including in cases of pricing or product errors, suspected fraud, or unavailability.

Prices, product availability, promotions, and other purchasing information may change without notice. Prices are stated in U.S. dollars and do not include applicable taxes or shipping charges, which will be shown before you complete your order. Payments are processed through third-party payment providers and are subject to their applicable terms and privacy practices.

Shipping, returns, and refunds are governed by our Shipping & Returns Policy, which is available on the Site and is incorporated into these Terms. Any warranties applicable to a particular product are stated in the materials accompanying that product.

8. Intellectual Property

Unless otherwise indicated, the Site and its contents—including text, graphics, logos, product names, photographs, illustrations, videos, designs, and other materials—are owned by or licensed to Alpha Tech Pet and are protected by applicable intellectual property laws.

You may access and use Site content for your personal or legitimate business use in connection with Alpha Tech Pet products. You may not reproduce, distribute, modify, publish, sell, or commercially exploit Site content without our prior written permission, except as permitted by law.

9. Trademarks

Alpha Tech Pet names, logos, product names, trademarks, service marks, and related branding may not be used without our prior written permission, except as otherwise permitted by law.

Third-party trademarks appearing on the Site remain the property of their respective owners.

10. Third-Party Links and Services

The Site may contain links to websites, resources, or services operated by third parties, and may use third-party services (such as analytics, security, and payment tools) to operate. These links and services are provided for convenience and do not necessarily constitute an endorsement by Alpha Tech Pet.

We do not control and are not responsible for third-party websites or services, their content, availability, security, products, or privacy practices. Your use of them is subject to their own terms and policies.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

ALPHA TECH PET DISCLAIMS ALL WARRANTIES REGARDING THE OPERATION, AVAILABILITY, ACCURACY, OR COMPLETENESS OF THE SITE OR ITS CONTENT, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

Any warranties applicable to a particular Alpha Tech Pet product are governed by the terms accompanying that product, if any.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALPHA TECH PET AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE. IN NO EVENT WILL OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SITE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US THROUGH THE SITE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

13. Indemnification

You agree to defend, indemnify, and hold harmless Alpha Tech Pet and its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, or your use of any product in a manner inconsistent with its label or applicable law.

14. Privacy

Your use of the Site may involve the collection and processing of personal information. Please review our Privacy Policy for information about how personal information is collected, used, and handled. The Privacy Policy is incorporated into these Terms.

15. Changes to the Site or These Terms

We may update the Site and these Terms from time to time. When we make changes to these Terms, we will post the revised Terms on the Site and update the Effective Date shown above.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

16. Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, to us, or to third parties. Sections 8 through 14 and 17 through 19 survive termination.

17. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles, except where applicable law requires otherwise. Subject to any rights that cannot lawfully be waived, any legal action arising out of or relating to these Terms or the Site shall be brought in the state courts located in Middlesex County, Massachusetts, or the United States District Court for the District of Massachusetts, and you consent to the jurisdiction of those courts.

18. Severability and Entire Agreement

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect. These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and Alpha Tech Pet regarding your use of the Site.
